The General Data Protection Regulation will came into full force on 25 May 2018. It is unquestionably the most ground breaking piece of EU legislation in the digital era. The changes introduced are fundamental and far-reaching. Not only does it apply to personal data of EU citizens stored in the EU, it also applies to personal data of EU citizens which is stored outside the EU.
The Regulation significantly enhances data subjects’ rights as well as giving them greater control over their personal data. It also increases data controller accountability for data privacy and compliance. Breach of the regulation will have serious financial penalties for data controllers. Furthermore, disgruntled data subjects may now have a right of action against the data controller for non–material damage. It is essential that all organisations comply with the GDPR requirements.

The GDPR gives data protection authorities more robust powers to tackle non-compliance, including significant administrative fining capabilities of up to €20,000,000 (or 4% of total annual global turnover, whichever is greater) for the most serious infringements. The GDPR also makes it considerably easier for individuals to bring private claims against data controllers when their data privacy has been infringed. It allows data subjects who have suffered non-material damage as a result of an infringement to sue for compensation.
